Fallout of the Kovy Arbitration Around The League

I touched on this slightly in the original Arbitration fanshot I put up yesterday...

Apparently the league is now looking into the Pronger, Savard & Luongo contracts. There's an in-depth article on Puck Daddy from Greg Wynshynski...

Makes a lot of sense that teams like Boston & Vancouver are quick to aid the NHL in their "investigation" as the Robert Luongo & Marc Savard contracts are somewhat starting to resemble ball & chains to their salary caps & team structures. I also find it very interesting that the Flyers are noticeably upset over the NHL probing Chris Pronger's contract. When compared to Luongo & Savard, the Flyers have the most to lose should Pronger's contract be thrown out following his Conn Smythe worthy cup run...

I still think that the 3 teams are going to get away with barely a slap on the wrist. The burden of proof in the Kovalchuk case was that the term, the salary structure & the movement clauses were only malicious in conjunction with one another.

The difficulty in proving that BOP & considering that these guys & Hossa have already played out a year of their contract means that the NHL's hands are still tied, even if their track record of going back on business propositions is spectacular. Plus Kovy's contract represents the absolute limit a team can push the envelope, in comparison, all the contracts don't add up.

Personally I'm just glad we Penguins fans don't have to deal with crap like this. It's nice to have a competent & ethical management to rely on...

the Flyers have the most to lose should Pronger’s contract be thrown out following his Conn Smythe worthy cup run…

There’s a rumor going around that when Pronger is going to retire in a few years, Philadelphia might trade him to a team that needs help getting to the salary cap floor, like ATL or NYI.

Pronger retires so he gets no money, but his $5 million cap hit stays, which is helpful to the team that acquires him (they’d only have to actually spend $40 million of their dollars to get to a $45 million cap floor, for example.

All speculation but it would make sense. It’s shady, but that’s the landscape of NHL finances these days.

I’m still having trouble deciding which organization has the weirder CBA, the NBA or the NHL…

The NBA has barely any restrictions on a salary cap at all & is famous for giving mediocre players big contracts & the NHL’s CBA is pretty much it’s own crapshoot…

My kingdom for a CBA that actually makes sense…

(the only reason I’m discussing the CBA is because there’s nothing to talk about anyway till Octpber)

I have two ideas for how the NHL could end these shenanigans.

 Number one: Have each contract’s cap hit equal the actual amount paid that year. This would obviously stop the cap-hit reducing contracts, but would limit teams’ and players’ options significantly.

Number two: If a player retires, go back and recalculate his cap hit for past years, fining the team for every year he’s over the cap! They could grandfather in current contracts and start this with contracts signed after next year. This way, teams could frontload contracts if they wanted, but could not exploit the cap.

What do you guys think?

Regarding number one:
What’s to stop GMs in rebuild-mode from making wonky contracts paying heaps now, but very little when they, once again, have a shot at the playoffs?
Sign your star players to multi-year contracts, paying them the vast majority the first couple of years, while the noobies grow up. But, then paying them peanuts when you have a shot at the playoffs, and is fighting the cap again.

Or, the reverse, for GMs in win-now-mode, sign your star players for peanuts the first couple of years, but with massive payouts later in the contract. Although, I imagine it’d be harder to make the players go for that one.
Imagine, if Shero, when their contracts expire, resigned Crosby and Malkin to contracts that pays them only a few millions for 3-4 seasons, and then league max for as many.
Sure, your team wouldn’t be competitive after the 3-4 years, but, during those years you’d have no trouble getting top notch wingers.

While the principle of the idea is sound, it would need some fine print to disallow moves such as these, or else it would just close one loophole, and open another.

Here’s what I’m having trouble with …

There are reports circulating that the NHL is “still investigating” Pronger’s contract to see whether it is a cap circumventing contract.

But what the *$&# do they need to “investigate”? They know exactly what is contained in the contract, and they know how old Pronger is. So all they have to do is decide whether they want to pursue a belated rejection of the contract. That’s not “investigation”. That’s “deciding”.

Speaking of taking too much time to do stuff … how the $#$% long does it take Kovalchuk and his agent to discuss offers and decide on one? Can’t they just sit down and hash out what they want and what the offers are, then pick one? And really, haven’t they already had plenty of time to sort out what they want, etc?

And to complete my rant: While I would love to see Hossa’s contract kicked to the curb, how in the world would that be legal? He’s already been playing on it for a year, and it’s not like the league has suddenly come into new information about the contract. It seems remarkably suspect to think they could just void his contract now, when they accepted it a year ago).

I totally agree with the arbitrator’s decision regarding Kovalchuk’s contract, but the rest of the circus is kind of unacceptable in my mind. It makes me want to bash my head repeatedly against solid objects until it all goes away.

I hear ya, PR…

This CBA really is broken & the NHL has the consistency of mud when it comes to enforcing it… This Kovy thing is really getting out of hand… It’s like the LeBron saga only no one really cares this time…

I doubt they’d whack the older contracts. This Kovy rejection is now, for better or worse, is the new line in the sand…
